A 51-year-old Oyster Bed man was sentenced today in provincial court to serve two and a half years in a federal correctional facility for sexual assault.

The sentence was imposed in the case of Kevin Charles MacKenzie.

MacKenzie sexually assaulted a girl who was 16 years old when she went to his residence to see some kittens.

The court was told MacKenzie gave the teen cigarettes to smoke and beer to drink.

As she began to feel the effects of the alcohol, he removed her pants and sexually assaulted her. Despite her protestations and demands that he stop, MacKenzie continued to assault her.

He gave her even more alcohol then engaged in sexual intercourse with her against her will.

Provincial Court Judge Nancy Orr reviewed extensive case law on sexual assault in Canada and the range of sentences imposed.

She observed that denunciation and deterrence were paramount considerations  for the court in a case like this.

MacKenzie, she said, had taken advantage of a teenage girl who had gone to his residence for a very innocent purpose.

Orr said the court cannot restore to the victim what she has lost as a result of MacKenzie's actions.

Orr ordered MacKenzie to provide a sample of his DNA for the national DNA databank.

He must also register with the national sex offender registry.

A weapons prohibition was also imposed.

    As someone who have been a victim of rape and seeing others be victimes of rape this disgusts me. To this day I still don't understand how someone could do this to someone. The man who did it to me got sentenced for four years in federal for someone else, the police couldn't prove my case at all apparently. Sex offenders of any kind deserve way more than a couple years...

    I found the initial coverage very upsetting and offensive. Thank you for taking out the graphic details, which were unnecessary.

    Based on a recent sentencing, raping a minor turns out to be 2.5 times worse than selling contraband cigarettes. Strange world.

    It references sexual assault and intercourse, there aren't any graphic details. If you can't handle those two terms then perhaps reading an article titled "Man given federal time for raping teen who visited to see some kittens" wasn't a good idea. Oh, and this wasn't "foreplay", which by definition is generally understood to be consensual stimulation intended to precede sex. There was nothing consensual about it, not was it, I'm guessing, stimulating for the young victim.

      When the story first ran it had very specific, graphic details in it. The version you're reading now has the details taken out... There's nothing graphic in this version

      It's like talking about mental illness to remove the stigma - we should be open about this stuff so that victims won't feel ashamed. If it's too difficult, don't read it.

    A disgusting old man rapes a young girl and only gets 2.5 years?? How is that possible? He should be in jail AT LEAST 3 times that. That girl will have to live with what he did for the rest of her life... He should have to suffer much longer than that.

      plus he should NOT be in protective custody put him in with the reg con's let them deal with him. i'm sure he will get all that he wants from the guys they will love him. but we all know they must PROTECT the guilty. thats why he will be out in less then a year.

    Disgusted that these MONSTERS get such little time...Judge Orr Im disappointed in the sentence this needs to be longer .Garry Livingtone should also be made to go across as well . JUDGE DOUGLAS really open up your eyes and read your GD files and make these crimanals pay....if you cant do that then RETIRE!!!!!!!!

      i wonder how the judge would act if his child was the victim and we gave him 2 years in a nice place like prison. i'm sure he would want the rapist to serve his time on weekends. think judge maybe the next time this guy could go after one of your family. how would you feel then?

    This Island is going to hell , Why do these guys get such a small punishment for such offensive crimes ! Throw the book at them, Minimal punishment is why there is so much of it here, Wake up It's about time for the government & the courts to protect the youth of PEI

    Could you not put that he performed foreplay, rather than being so graphic. This is a small island and if you want to protect the innocent, leave out such horrific details to such a matter!!

    Sexually assaulted would have sufficed, no need to write the gory details of this girls assault. She and her family do not need to relive this assault in writing, have some consideration before you publish.
