Injured man alleges Evans-Renaud was negligent by speeding and driving while impaired

The victim of a hit-and-run on the UPEI campus is suing the man who left him bloodied on the side of the road.

On Feb. 6, Adam Molyneaux filed a statement of claim against Zachary Evans-Renaud who was convicted of leaving the scene of the March 13, 2011 accident.

Evans-Renaud was sentenced to serve four months in jail.

Molyneaux is seeking an unspecified amount in damages, including for future loss of income and care costs.

The lawsuit came after Evans-Renaud hit Molyneaux from behind while he was walking along a road on UPEI's campus.

Molyneaux went over the Toyota Corolla's hood and his father found him lying bloodied and hurt by the side of the road.

Evans-Renaud didn't stop to check on Molyneaux and although the windshield was smashed during the collision, Evans-Renaud said he didn't realize he had hit a person.

Those details were all included in the criminal proceedings against Evans-Renaud.

Molyneaux's statement of claim alleged Evans-Renaud was negligent in several ways, including by not driving at the appropriate speed, driving while impaired by alcohol and not taking evasive action when he knew an accident was about to happen.

Because of the accident, Molyneaux suffered injuries, including to his lower back, right knee and right leg, the claim alleged.

Molyneaux alleged his injuries resulted in lost income, future care costs, pain and suffering.

As of Monday Evans-Renaud had yet to respond to the claim.

    Mr. Molyneaux has to sue. Insurance companies won't see a guilty conviction. The lawyer will take 35% of his settlement off the top. Mr. Molyneaux will also have to pay for disbursements (phone calls to photocopying) up front. This can take up to 65% of his settlement. So the money he will need compensate for lost wages or any medical treatments such as physio, assistive devices because your provincial health care system does not provide this his bills could suffer along with his health as he runs out of money. His potential earning power can be inhibited and his ability to get secondary health insurance because he has pre existing conditions. All of this and he will be looking at a 5-7 year time frame. Hope he isn't in a hurry for it. The hit and run is just the start.

    Without lawyers there would be no recourse. Lawyers have a job to do...let them do it!

    Ya really Kays, and what is so wrong about " only getting what he deserves"? Well Duh! what else should he expect? and why would he be doing this in the first place? to make a profit? Are you for real?

    Four months for drinking and driving, hitting a person, leaving the scene of an accident and obviously lying... I'm beyond disgusted right now. What is wrong with our system that we can allow this to happen???

    The fact Renaud appealed shows just how remorseful he really was-how was this guy raised anway...you left someone for dead on the side of the road dude-you should have man'd up!

    I'm still trying to get a grip on the fact that he only received 4-months in jail for the crime he committed.What a light slap on the wrist. Judicial system on P.E.I. is certainly a joke!!

    Molyneaux is correct in seeking reparations for this accident in the civil courts. But please make no mistake about it, the real winners here are the lawyers and the system. They are the ones who stand to profit. Molyneaux will not profit even if he wins the case he will only get what he deserves.

      I certainly hope his lawyers will make a profit. That is the point of having a job, after all. Are you implying that you somehow know they will make an unfair profit?

      What an interesting point of view Bill. Imagine someone earning a profit for completing their job. Do you expect lawyers and "the system" to work for free? If so I guess doctors and everyone else who provides a service should do the same. I agree that lawyers are over paid, but that's the type of position you hope to find after getting yourself a good education. I hope you didn't earn any profit when you founded P.E.I's buy sell and trade or your statement above would seem contradictory.
