CHARLOTTETOWN, P.E.I. — A P.E.I. man who went into a ditch while driving drunk was sentenced recently to 28 days in jail.
Richard Francis Arsenault, 57, appeared before Chief Judge Nancy Orr in provincial court where he pleaded guilty to failing the breathalyzer.
The court heard that on Nov. 20 at around 11 p.m., the RCMP responded to a single-vehicle collision where a witness said they saw Arsenault’s vehicle go into a ditch.
Roads were snow covered and driving conditions were poor at the time.
Crown attorney Jeff MacDonald said Arsenault provided breathalyzer samples that were more than twice the legal limit.
Arsenault had a prior record that included two drunk driving-related offences.
Along with the jail time, which Arsenault will serve on weekends, he must perform 150 hours of community service instead of paying a fine.
Arsenault will be on probation for 18 months and is banned from driving for one year.
