THREE RIVERS, P.E.I. – A Montague man who assaulted a woman, threatened to have her beat up and breached three orders to stay away from her was sentenced recently to 90 days in jail.

Leo Joseph Woods, 50, appeared before Chief Judge Nancy Orr in provincial court in Three Rivers where he pleaded guilty to assault and uttering a threat.

Woods also pleaded guilty to three counts of breaching an undertaking.

Crown attorney Nathan Beck told the court the victim reported to the police that Woods assaulted her.

She also disclosed that he hit her two other times and threatened to have her beat up.

When the police arrested Woods, he made an allegation against the victim and both were later released on undertakings.

The RCMP later responded to three calls over several days about Woods being in the victim’s apartment despite orders that he stay away.

Beck told the court Woods had an outstanding balance of about $36,000 owing to the province in fines and other charges.

Defence lawyer Jared Kelly said Woods took full responsibility for his behaviour.

Kelly told the court Woods needed about 280 hours of work to maintain his EI eligibility.

He asked for Woods to be able to serve his sentence on weekends so he could continue working.

Orr said she thought Woods forfeited the right to an intermittent sentence.

Woods was kept in custody after his most recent arrest and Orr gave him credit of 12 days for time served.

He will be on probation for two years and must pay $500 in victim surcharges.
