CHARLOTTETOWN, P.E.I. —

A P.E.I. man who said he kicked a police car window because the arresting officers wouldn’t take his handcuffs off when he asked them to was sentenced recently to 37 days in jail.

Lloyd Thomas MacDonald, 47, appeared before Judge John Douglas in provincial court in Charlottetown where he pleaded guilty to damaging property, theft and breaching his probation.

The court heard that on Dec. 24, the police arrested MacDonald on another matter and were driving with him in the backseat when he broke a passenger-side window by kicking it.

When MacDonald addressed the court before hearing his sentence, he said he had asked the officers to take his handcuffs off and they wouldn't.

He knew it didn’t justify kicking the window, MacDonald said.

The court also heard MacDonald went to a Superstore in Charlottetown on Sept. 21 and stole a chocolate milk worth $1.39.

He was on probation at the time with a condition that he not go to the Superstore.

Douglas said the theft was minor, but MacDonald’s criminal record and the fact he wasn’t allowed to be at the store were aggravating factors.

He gave MacDonald enough credit for time served to cover the sentences for all three charges, although MacDonald remained in custody awaiting trial on several other offences.

MacDonald must pay $316.25 in restitution for the damage to the police vehicle window.
