CHARLOTTETOWN, P.E.I. — A P.E.I. man who had the same cheque deposited twice and bought items with a stolen credit card was sentenced recently to 60 days in jail.

Bradley Gary Hardy, 28, appeared before Judge Jeff Lantz in provincial court in Charlottetown where he pleaded guilty to several charges, including fraud, using a stolen credit card and breaching his probation.

Crown attorney Jeff MacDonald told the court that in September, Hardy asked someone to deposit a cheque for him, which they did using a banking app.

MacDonald said Hardy later deposited the cheque a second time.

Later that month, Hardy was wearing an electronic monitoring bracelet when he bought cigarettes and alcohol using a credit card that was reported stolen.

In an unrelated incident, the court heard Hardy was on probation when he sent text messages and left voicemails for a woman he wasn’t supposed to have contact with. 

MacDonald said Hardy also failed to attend court several times.

Defence lawyer Alex Dalton told the court the text messages and voicemails weren’t of a threatening nature.

She also said Hardy, who is taking Suboxone, has underlying mental health and substance abuse issues.

Before hearing his sentence, Hardy addressed the court and asked for house arrest, which he would have served at his parent’s house.

Lantz sentenced him to jail time and placed Hardy on probation for 18 months, which included a condition he be subject to electronic monitoring, if directed.

Hardy must also pay restitution to the person who cashed the cheque for him and to the Royal Bank for the money spent with the stolen credit card.
