THREE RIVERS, P.E.I. - A P.E.I. man whose truck was hauling a boat while he was driving drunk was sentenced recently to three days in jail.
Brian Edward Schmeisser appeared before Chief Judge Nancy Orr in provincial court in Georgetown where he pleaded guilty to drunk driving.
Crown attorney Nathan Beck told the court that on Sept. 5 at around 4:45 p.m. the RCMP responded to a call where they found Schmeisser and another man near a truck and boat that were almost in a ditch.
The court heard Schmeisser had agreed to haul the boat with his truck but had stopped after almost putting it in the ditch.
When the police arrived the two men were waiting for a tow truck and Beck said it appeared Schmeisser took action to prevent an accident.
While Schmeisser was talking to the police he denied drinking that day, but said he had the night before.
Beck said Schmeisser later provided breath samples that were almost twice the legal limit.
Before hearing his sentence, Schmeisser addressed the court and said he was very surprised his blood alcohol level was over the legal limit.
Along with the jail time, Schmeisser must pay a $1,500 fine and a $450 victim surcharge.
He is banned from driving for one year.
