Judge doesn’t believe P.E.I. man’s explanation for impaired-driving related charges

GEORGETOWN, P.E.I. — A P.E.I. judge dismissed a man’s claim that he did all his drinking after his truck had been parked and turned off.

Chief Judge Nancy Orr sentenced 34-year-old Daniel Adrean Bradley in provincial court to 21 days in jail for refusing a breathalyzer and 21 days for having care and control of a vehicle while impaired by alcohol. The sentences are to be served concurrently.

Bradley was also fined $1,500 and is prohibited from driving for one year.

Jessica Pierlod of Morell testified Bradley parked his truck outside her grandmother’s home in Green Meadows on Dec. 10.

After hearing music blare from the truck for a few minutes, Pierlod went outside. She found Bradley slumped in the driver’s seat, unresponsive.

She testified that she shouted at Bradley and shook him, only to watch him pass out.

Pierlod then shut off the truck, took the keys away and called police.

Bradley then took the stand to offer a creative version of events that the Crown called “far-fetched’’ and Orr determined as not believable.

Bradley told the court he only had four hours of sleep over the weekend due to suffering from anxiety.

He thought going for a drive on Monday, Dec. 10 might help.

He claimed that he picked up a quart of rum at the liquor store in Morell to drink at home if he was still struggling to sleep.

Bradley said he started feeling drowsy, pulled his truck over, cranked up the radio, and wound down the window.

He told the court he remembers a woman taking his keys and that made him feel safe to consume over half his bottle of rum, which was never found in his truck.

Orr noted Bradley was not seen consuming any alcohol while parked in his truck, and people were watching him intently out of concern for his wellbeing.

Bradley was convicted in 2007 for refusing a breath test.
