Island man jailed for assault in apartment

CHARLOTTETOWN, P.E.I. — A P.E.I. man who was found guilty of throwing a woman to the ground and hitting her in the head inside her apartment has been sentenced to 135 days in jail on two charges.

Mark Anthony Tippett, 33, appeared before Judge John Douglas in provincial court in Charlottetown for sentencing after a recent trial where he was found guilty of assault causing bodily harm.

In sentencing TIppett, Douglas said the physical harm to the victim was on the low end, but the emotional harm was on the high side because the assault was in her home.

During the recent trial, the victim testified she and Tippett got into an argument in her apartment after she asked him for part of a sleeping pill he was taking.

The victim testified Tippett smashed some things in her apartment, threw her to the floor and hit her in the head.

She said he later punched her in the face. 

On Tuesday, Crown attorney Lisa Goulden said Tippett’s compliance with no-contact orders involving the victim has been “problematic.”

Goulden said deterrence should be the focus of Tippett’s sentence and it should include a condition to stay away from the victim.

“She’s the one who gets hurt,” Goulden said.

Tippett, who has a history of incidents involving the victim, spoke before his sentencing and said he wouldn’t end up back in court.

“I just can’t keep doing this,” he said.

He also told the court he knows the onus is on him not to have contact with the victim, but she’s the one who has been going to find him, not the other way around.

Tippett, whose sentence included time for charges of breaching his probation and damaging property, was in custody since his arrest for the assault.

With credit for time served he was left with 62 days on his sentence.

He must also provide a DNA sample for the national databank and will be under a weapons prohibition for 10 years.
