Charlottetown teen pleads guilty to second degree murder

CHARLOTTETOWN, P.E.I. — A Charlottetown teenager pleaded guilty Wednesday afternoon to the second-degree murder of 24-year-old Cody Robert MacLean of Kingston, P.E.I.

Logan Raymond Kenneth MacAusland, 19, showed little emotion as he entered the guilty plea in front of a packed courtroom that included several people that appeared to be either teens or young adults.

The Crown stayed charges of assaulting a police officer and resisting arrest.

MacAusland will be sentenced on Nov. 15.

A Gladue report has been ordered for MacAusland, who is a member of the Mi’kmaq community. Gladue reports can detail information on the unique circumstances of an Aboriginal person who has been accused or convicted of a crime. The court can consider the report during sentencing.

MacAusland, who has been in custody since his arrest in February, will remain in jail.

Police received a call at 1:13 a.m. on Feb. 5 of a fight in progress on Spring Street near Churchill Avenue in Charlottetown.

When police arrived on the scene, MacLean was found with serious injuries. Neighbours described the scene as overwhelming.

A witness saw a young girl take her shirt off and give it to the police officer who put the shirt on the body and then began to perform CPR.

Within minutes, more police officers arrive on the scene, and police took turns performing CPR on MacLean. Paramedics then transported the man to hospital where he later died.

MacLean, who was father to a baby boy, was a first-year marketing and advertising management student at Holland College’s Tourism and Culinary Centre campus in Charlottetown.

The murder is the first in P.E.I. since Joel Lawrence Clow killed Traci Lynn Lynch in 2015.

Clow was sentenced last month to 12 years for manslaughter on top of the four years he had already spent in custody.
