Charlottetown council won’t reconsider Palmers Lane apartment vote

CHARLOTTETOWN, P.E.I. — Charlottetown council will not reconsider its decision in September to approve a rezoning application from low density residential to medium density residential for 38 Palmers Lane.

The vote was 7-3 in favour of not reconsidering the matter with councillors Bob Doiron, Jason Coady and Mitchell Tweel opposed.

In September, council approved an 18-unit apartment for the property, an issue which was appealed to the Island Regulatory and Appeals Commission. The appellants also applied to the city to have the decision reconsidered by council as they felt council made an error. 

The developers' dissatisfaction with council’s decision is based in their interpretation of the official plan and the zoning and development bylaws.

“While I appreciate the concerns expressed by the appellants, staff felt the argument for reconsideration did not meet the threshold outlined in the zoning and development bylaws,’’ said Coun. Greg Rivard, chairman of the planning and heritage committees.

“There are three tests, if you will, that the appellants have to meet before council can reconsider and planning staff indicated in the report that there is no appearance of clear doubt as to the correctness of council’s original decision.’’
