Two men charged with drug and weapon offences

One of two Sydney men charged with drug and weapon offences continues his release while the second has been remanded pending the outcome of a bail hearing.
Both accused were arrested Wednesday in Sydney and charged with multiple offences.
John Paul Bergeron, 37, of Grandview Street is charged with two counts of careless storage of firearms, two counts of unauthorized possession of firearms, two counts of possession of prohibited weapons, two counts of possession of firearms knowing he had no authorization and single counts of possession for the purpose of trafficking in cocaine, illegal possession of cannabis and possession of cannabis for distribution.
Bergeron continues his release and is now scheduled to enter pleas March 25.
The second accused, Justin Ross Digou, 39, is charged with the same drug and weapon offences as Bergeron along with two counts of breaching court orders, and single counts of fraudulent personation and possession of a firearm while prohibited.
Digou has consented to a remand pending the outcome of a bail hearing now scheduled for March 1.

Trial set on wildlife act charge

One of two accused charged with hunting with the assistance of light has pleaded guilty and was fined while the second has elected to be tried in provincial court.
Jared Cathcart, 25, of Main Street, Glace Bay, pleaded guilty to the charge which occurred Nov. 19, 2020 in Boisdale.
He was fined $2,000 and given until September to pay.
The second accused, Alexander Burke, 20, of Vet Street, Glace Bay, entered a plea of not guilty and was assigned a trial date.
He is now scheduled for trial Nov. 9.

Three-year jail sentence recommended

A Sydney man, with no prior criminal record, is facing a possible three-year jail sentence after pleading guilty to a charge of possession for the purpose of trafficking in cocaine.
Robert Donald Cormier, 42, of Applecross Drive, Westmount, was charged Feb. 23, 2020, after Cape Breton Regional Police searched a vehicle and found 302 grams of cocaine along with $3,385 in cash.
Both the Crown and defence have recommended a three-year sentence along with a 10-year ban on possessing firearms as well as forfeiting the drugs and cash. Also requested was a DNA order.
Cormier also faces a second charge of possession of money knowing it was obtained by crime. It is expected that charge will be withdrawn at the time of sentence.
After hearing the sentence recommendation, provincial court Judge Dan MacRury adjourned the session expressing concern that the sentence may be too low.
He plans to review the case and will now impose a sentence March 19.

Trial set on home invasion charge 

One of two women charged in connection with a home invasion has elected trial in provincial court while an arrest warrant has been issued for the second accused.
A warrant has been issued for Tiffany Nicole Diflavio, 32, of Green Road, Sydney who is charged with two counts of assault and single counts of mischief and committing a home invasion.
The offences are alleged to have occurred Nov. 19, 2020, at a residence on Lingan Road.
The warrant was issued after Diflavio failed to attend court earlier this week.
Also charged is Emily Eileen Laureen Tubrett, 22, of Sydney River who is charged with three counts of assault and single counts of home invasion, mischief, impaired driving and driving with a blood/alcohol level exceeding the legal limit.
Tubrett has entered not guilty pleas and is now scheduled to stand trial Nov 15-16.

Two trial dates scheduled 

Two trial dates have been scheduled for a man from northern Cape Breton on charges including break and enter.
Richard James MacKinnon, 30, of Bay St. Lawrence is charged with break and enter, assault with a weapon (a tire iron), unlawful entry, possession of an instrument that could be used in a break-in (tire iron), uttering a threat and breaching a court order.
The offences are alleged to have occurred Jan. 8 in New Waterford.
MacKinnon is scheduled to stand trial in provincial court Nov. 18.
MacKinnon and a female co-accused are also charged with assault which is alleged to have occurred Sept. 3, 2020 in New Waterford.
Both accused are now scheduled to stand trial on Nov. 17. Both continue their release on conditions.
