CHARLOTTETOWN, P.E.I. - A Cornwall man who parked his vehicle after bar staff told him they didn’t think he should be driving was sentenced recently to one day in jail for failing the breathalyzer.
Lei Xu, 33, appeared before Judge John Douglas in provincial court in Charlottetown where he entered a guilty plea.
The court heard that on Oct. 23, at around 12:50 a.m., Charlottetown police responded to a report from Hunter’s Ale House staff about a possible impaired driver who was getting in his vehicle and planning to leave.
Xu later provided breathalyzer samples that were above the legal limit.
Defence lawyer Chris White told the court Xu didn’t feel he was impaired at the time and when bar staff told him they didn’t think he should drive he returned the vehicle to a parking space and got out.
Along with the jail time, Xu must pay a $1,000 fine and is banned from driving for one year.
