Sentencing delayed for man caught with pot at P.E.I. school

A P.E.I. provincial court judge says she wants more information before sentencing a man who told police he was selling drugs at a Charlottetown school.

Nicholas George Nash McInnis, 18, appeared before Chief Judge Nancy Orr in provincial court Tuesday where he was supposed to be sentenced for possessing marijuana for the purpose of trafficking.

Instead, Orr adjourned the matter for a third time after she heard a joint sentencing recommendation in January.

That recommendation was for a period of probation with no jail time.

A Gladue report, which is a special type of pre-sentence report for Aboriginal offenders, was prepared for the case, but on Tuesday, Orr said without further information that wasn’t included in it she wasn’t in a position to impose a sentence.

During two previous court appearances, Orr said she didn’t believe the joint recommendation was in line with the principles of sentencing she was required to follow.

McInnis was caught with marijuana and cash at Charlottetown Rural High School while he was a student there.

He told police he was selling marijuana to about six students.

Orr said the case was a matter she wasn’t taking lightly and she spent a lot of time on it.

She asked counsel to have the information she needed provided to the court, including information from Child and Family Services in Manitoba, and from Charlottetown Rural.  

Orr adjourned the matter until March 26 to set a date for sentencing.
