A Charlottetown man who was driving a car from which someone shot a bystander in the eye with a pellet gun was given a suspended sentence Thursday.
Dennis Patrick McGillvray, 41, appeared before Judge John Douglas in provincial court in Charlottetown where he pleaded guilty to careless use of a firearm.
The court heard McGillvray was driving a vehicle on July 16 with four other people and three pellet guns in it.
Some of the people in the vehicle were shooting the pellet guns into the street and one of the shots hit a bystander, although the court heard it wasn’t clear who was responsible.
Defence lawyer Isabelle Keeler said McGillvray regretted his participation as the driver and apologized.
McGillvray will be on probation for nine months, during which time he is banned from possessing a firearm.
He must also pay a $100 victim surcharge.
Barry Scott Laybolt, 29, was previously sentenced to 30 days in jail and Joshua John Betts, 18, was given a suspended sentence for their roles in the shooting.
