A Charlottetown man was sentenced to jail on Thursday for forcible entry and assault in relation to an incident in January.

Kirk Randall Schurman, 42, received seven days in jail to be served on weekends and probation.

On Jan. 3, Schurman and his friend forcibly entered a Charlottetown residence where a woman was staying with family members and her children.

The Crown prosecution said Schurman was “irate and enraged” and was aggressive with three of the family members and physical with the woman while the children watched.

Schurman pleaded guilty to the charges at a prior court appearance.

The Crown was seeking a sentence of 10 to 30 days for the assault and 60 days consecutive for the forcible entry charge.

Charlottetown provincial court Judge John Douglas told Schurman that an aggravating factor was that the incident occurred in front of the children.

But Douglas noted that Schurman’s pre-sentence report was positive. Also positive was Schurman’s interaction with support services since the incident. Schurman had no prior criminal record, the judge added.

In addition to the jail term, Schurman was placed on probation for eight months and ordered to pay a $100 victim surcharge for each offence.
