P.E.I. man tried to run woman off road, assaulted her in stranger's Morell home

James Calvin McFadden appeared before Chief Judge Nancy Orr in provincial court in Georgetown Thursday where he pleaded guilty to assault, dangerous driving and damaging property.

The court heard the victim was at McFadden’s home on March 16 and left despite him wanting her to stay.

Crown attorney Cyndria Wedge said the victim drove away, but McFadden pursued the woman, racing ahead as he tried several times to stop her.

At one point when the woman stopped, McFadden got out of his vehicle, reached through the victim’s window and hit her head off parts her vehicle.

The victim managed to get away, but McFadden continued to follow and at one point passed her before turning his vehicle sideways to block the road.

She tried to get around McFadden’s vehicle, but hit it on the way by.

McFadden resumed his pursuit, caught up to the victim and starting slamming the vehicle he was driving into hers.

The court heard the chase ended in Morell when the victim saw a house with a porch light on and what she thought looked like a TV on inside.

She went to the house, yelled for help and got inside the mudroom.

McFadden followed her there, grabbed the woman by the hair and slammed her against the walls.

The victim reported that he stopped the assault and left.

She left soon after and drove away with a flat tire.

Her vehicle eventually stopped running and the court heard she fell asleep in her car because she was exhausted.

Someone saw her later and drove her home.

On March 17, the victim went to tell the homeowners what happened.

One of the homeowners had already called the police by then and reported waking up to her dog growling.

McFadden broke a window during the assault and the homeowner found several items thrown around in the mudroom.

The Crown and defence made a joint recommendation of a nine-month sentence with three years of probation and a driving prohibition.

McFadden has been in custody since his arrest.

The Crown also sought a total of more than $14,000 in restitution for the homeowners and two insurance companies.

McFadden’s mother owned the vehicle he was driving.

Orr adjourned the matter until June 22 for sentencing.
