Allan James Broderick, 43, of Summerside, Prince Edward Island, appeared from the prisoner’s dock in Miramichi provincial court Monday, Dec. 29 before judge John Friel for a sentence hearing on two charges of assault.

Crown prosecutor Jean-Guy Savoie said Broderick pleaded guilty to the charges stemming from a Dec. 7 incident on a Via Rail train in Bartibog, a small community between Miramichi in Bathurst in New Brunswick.

Savoie said once Broderick pleaded guilty, the Crown requested the preparation of victim-impact statements. He said the victims had picked up the forms to complete the reports but they hadn’t been returned in time for the sentence hearing.

Savoie said he wanted to ensure the victims had the opportunity to complete their statements and asked that the sentencing be set over again.

Defence lawyer Simon Wood, acting as duty counsel, told the court Broderick pleaded guilty on his own and also requested an adjournment on sentencing in order to prepare a pre-sentence report.

Friel agreed with the requests and adjourned the sentencing to Jan. 30 at 9:30 a.m. in order for the Crown to check on the status of the victim-impact statements and for a pre-sentence report to be prepared.

New Brunswick RCMP arrested Broderick Dec. 7 at approximately 8 p.m. in Bartibog after two train employees were assaulted when they intervened to try to stop Broderick from being verbally abusive to another passenger.
