A 61-year-old P.E.I. man who was more than 2.5 times the legal limit was sentenced to seven days in jail after he failed a breathalyzer.
Kevin E. Clow plead guilty before Chief Judge Nancy Orr in provincial court in Charlottetown May 17.
The court heard on March 17 at around 11:45 p.m., police received a complaint of an impaired driver leaving Red Shores Racetrack and Casino and heading to Tim Hortons.
Police attended the Tim Hortons and saw the vehicle. Clow was not in it, but the keys were in the ignition and the headlights were still on.
He came out of Tim Hortons unsteady on his feet and demonstrated signs of impairment.
He provided breath samples that were more than 2.5 times the legal limit.
Clow had no prior criminal record.
Orr asked Clow if he had a problem with alcohol.
“Probably,” he responded.
In addition to jail time, he must pay a $1,500 fine and $450 to the victims of crime fund.
He is also prohibited from driving for one year.
