Edward Joseph Phalen appeared before Chief Judge Nancy Orr in provincial court in Charlottetown recently for a trial and sentencing.

After hearing from two witnesses, Orr found Phalen guilty of taking the vehicle without permission and breaching his probation.

The court also heard the agreed facts involving several other charges, including a theft from the No Frills store in Stratford.

He was on probation at the time.

After his arrest for that incident, Phalen admitted he stole a bottle of yogurt drink.

Phalen also failed to appear in court three times.

Along with the jail time, Phalen will be on probation for 18 months after his release, during which time he is banned from operating any motorized vehicle.

He must also pay $1,100 in victim surcharges.
