Man found living in parked vehicle goes to P.E.I. jail

CHARLOTTETOWN, P.E.I. – A Morell man who was living out of his vehicle when the police found him drunk behind the wheel was sentenced recently to three days in jail.

Brien McCarthy, 31, appeared before Chief Judge Nancy Orr in provincial court in Charlottetown where he pleaded guilty to having care and control of a vehicle while his blood alcohol level was above the legal limit.

Crown attorney Nathan Beck told the court the RCMP received a call on June 30 about a possible impaired driver parked on the side of the road.

When they arrived, the police found McCarthy in the driver’s seat with the engine on and beer in the backseat, Beck said.

McCarthy later provided breathalyzer samples that were almost twice the legal limit.

Defence lawyer Jason Morais said McCarthy was working that day and had a few drinks at a wharf when he finished.

McCarthy, who was living out of his vehicle at the time, later pulled over to the side of the road and drank more, Morais said.

Along with the jail time, Orr fined McCarthy $1,000 and ordered him to pay a $300 victim surcharge.

McCarthy is banned from driving for one year.
