A man who was caught selling marijuana out of his home in Scotchfort was sentenced to four months in jail.

Alfred William Gallant, 55, appeared before Chief Judge Nancy Orr in provincial court in Charlottetown for sentencing after previously pleading guilty to drug trafficking.

Gallant admitted to police he had been trafficking marijuana for years.

Gallant was dealing out of his own home and told police he sold it to pay for his own marijuana use.

A report on the case showed Gallant’s common-law spouse didn’t view what he was doing as trafficking because it was only marijuana and he only sold to people he knew.

Orr said she read that Gallant was smoking about seven or eight grams of marijuana a day while his wife and son knew he was selling it out of their home.

“You have to shake your head,” she said.

Even if marijuana laws change Gallant’s activities would still be illegal and in the meantime the law is quite clear, Orr said.

When the police arrested Gallant they seized $1,035 in cash and 65 grams of marijuana.

Defence lawyer Yolande Murphy said Gallant reduced his marijuana use significantly since his arrest to the point that he hardly uses it.

Before handing down her sentence, Orr said denunciation and deterrence were the main factors for her to consider and were particularly relevant in this case because of the pre-sentence report.

Along with the jail time Gallant must perform 100 hours of community service and he will be on probation for two years.

Gallant must also pay a $200 victim surcharge and forfeited everything the police seized.
