A Charlottetown man who said he was selling marijuana to help pay bills has been sentenced to eight months in jail.

Jeffery Stephen Gallant, 34, recently appeared before Judge Nancy Orr in provincial court in Charlottetown after previously pleading guilty to trafficking marijuana.

The court heard the police executed a search warrant on May 5 at Gallant’s home where they found between $3,400-$5,100 worth of marijuana, marijuana seeds and marijuana shake hidden in several places, including in a cooler, a coffee table and a filing cabinet.

They also found $1,200-$1,800 worth of cannabis oil in the fridge.

Gallant’s girlfriend, daughter and brother lived in the home, but he told police they didn’t know about the marijuana.

Defence lawyer Chris Montigny told the court Gallant accepted responsibility for his actions and had been smoking one joint a day, but since cut back to one a week. He also said Gallant made a bad choice and was trying to make extra money to pay bills.

Gallant sought to serve his sentence in the community, but before she decided what the sentence would be, Orr asked how house arrest would be appropriate.

“This is the site of his business,” she said.

Orr also said Gallant previously served two years less a day in New Brunswick for drug trafficking and it wasn’t a mystery what would happen if he did it again.

“If it’s a mystery to him it shouldn’t be,” she said.

Given the quantity of marijuana found in the house, Orr said she doubted there could be that much in so many different places without the other residents knowing it was there.

Orr told Gallant the sentence needed to show there were consequences for dealing drugs.

“All you’re doing is spreading misery in the world and the community,” she said.

The Crown had recommended an eight-month sentence and Orr said she found it to be reasonable.

Along with the jail time, Gallant will be on probation for 18 months after his release, he has a lifetime weapon prohibition and Orr ordered him to perform 100 hours of community service.

Gallant also has to pay a $200 victim surcharge and there was a forfeiture order for a scale and $1,760 in cash found in his home.
