A Cornwall man who refused to give a breathalyzer sample after his car rolled into a vehicle that was stopped behind his was sentenced recently to 45 days in jail.
Evan James Power, 26, appeared before Judge John Douglas in provincial court in Charlottetown for sentencing after he pleaded guilty to refusing the breathalyzer.
The court heard that on June 26 a police officer on patrol saw Power’s vehicle roll into one stopped behind him.
That vehicle’s driver was pregnant at the time.
Power misidentified himself to police who later found a suspended licence on him.
His vehicle also wasn’t registered.
The court heard Power was aggressive and belligerent and refused to give breathalyzer samples.
Defence lawyer Thane MacEachern told the court Power said his vehicle had a manual transmission, stalled and rolled back.
Power addressed the court before sentencing and said there were no words to justify what he did.
“I’d just like to own up to it and move on,” he said.
Along with the jail time Power is banned from driving for two years and will be on probation for nine months.
He must pay a $100 victim surcharge.
