PROVINCIAL COURT

A woman who was caught behind the wheel while drunk twice within less than two months was sentenced today to 33 days in jail.

Cheryl Dawn Lynch, 37, appeared before Judge John Douglas in provincial court in Charlottetown for sentencing after previously pleading guilty to two charges.

The court heard that on Oct. 2, 2015, the police were dispatched after a report of a possible drunk driver.

They found Lynch in the driver’s seat of her parked vehicle with the keys on the passenger seat.

Breathalyzer samples later showed her blood alcohol level was more than twice the legal limit.

On Dec. 2, 2015, police received two complaints about Lynch’s driving.

When they found her, Lynch was passed out in her vehicle’s driver’s seat.

At the time, Lynch was on a 90-day driving prohibition after the first offence and the police arrested her for having care and control of a vehicle while drunk.

Again she provided breathalyzer samples that were more than twice the legal limit.

Lynch’s lawyer told the court his client struggled with drinking, but hadn’t consumed alcohol since the incidents.

Douglas sentenced Lynch to three days in jail on the first offence and 30 days for the second, all to be served on weekends.

Lynch will have to pay a $1,000 fine and $400 in victim surcharges.

She is banned from driving for 18 months.

She should be made to serve her time straight thru., instead of weekends. You know with weekends she'll be out drinking again. At least if she served her 30 days straight and not weekends, maybe she could sober up and get her life back together. What this woman needs is tough love, not mollycoddling.

Wake up JD, she took no heed of a 90 day ban, what makes you think a years ban is going to stop her ??? And stop pussy footing around with these dumb weekend vacations.

Yeah and i'm sure she is really gonna learn her lesson after 33 days in the Sleepy Hollow Resort. Weekends at that. Of course only weekends, we wouldn't want to inconvenience her. Getting caught twice in a month is not only moronic on this twit's part, but it also shows that she shows no remorse for her actions. Wait until she kills somebody I guess. It always makes me feel safe driving out on the same roads as these clowns.

This notion of serving jail times on weekends is a joke. It's clearly no real deterrent as we continue to see numerous repeat DUI offenders on the Island. Is someone likely to lose their livelihood if they have to serve the jail time all at once? Probably. And maybe that will make them think twice about getting behind the wheel drunk.
