Judge Nancy Orr ruled Friday the vegetable farm took reasonable precautions

Brookfield Gardens has been cleared of a fish-kill related charge.

Chief provincial court judge Nancy Orr ruled Friday the vegetable farm took reasonable precautions to prevent runoff from a carrot field into the river that could have triggered the fish kill.

Brookfield Gardens was charged with contaminating a waterway after more than one thousand dead fish were recovered from a section of North River in August 2014.

The farm was fined earlier this year for environmental infractions connected to the incident.

    It's not enough to let off offenders just because they took "reasonable precautions". I don't think that Judge Orr should be the one who decides what is "reasonable precautions". If the fish killed can be linked to the actions of this farm, then they should be convicted. Maybe the "reasonable precautions" need to be looked at and to ascertain whether or not they in fact are reasonable. Farmers of every stripe are getting away with too many fish kills, this has to stop.

    Mary, your are 100 per cent wrong. Brookfield Farms is not organic so your lie to try to discredit organic farmers will not work. You are what is wrong with many people who comment on news stories. You knowingly tell lies to make a point or in your case to make organic farmers look bad and other not so smart people think it is true. If you can't make a comment without lying then don't make any comment at all. Or may your are just so stupid you don't know what you are saying.

      Bobby maybe it's you that needs to go read Brookfield Gardens web site . They may not be Organic , but they push the environmental side of their farming practices pretty hard ,which implies they practice Organic farming practices . So maybe next time before you call some one stupid you might want to check all your facts too .

    What I find very interesting here is the lack of outcry from the "environmentalist" we have on PEI! Could it be because this farm is "ORGANIC" and that would inform the general public that "ORGANIC" has "RISK" as well as "CONVENTional" farming? I ask if this fish kill were caused by a "conventional potato farmer" would the silence be the same? Oh the hypocrites we live with! Good Day And Good Farming!
