Teen seeking warmth in winter now gets bed in jail

SUMMERSIDE — Cody Robert MacLean broke into a cottage so he would have somewhere warm to sleep.

As a result, he’s guaranteed a warm bed at the local jail every weekend until his 90-day sentence is served.

MacLean, 19, of Charlottetown, was sentenced Tuesday in Summerside provincial court. He had entered a guilty plea to the break and enter charge and a second damage to property charge during an appearance in late May.

The incident happened during the winter, on Jan. 6, 2014.

He damaged a cottage in the Miscouche area before breaking into a second summer home, where he didn’t steal anything, only wanted to get out of the cold.

MacLean has a previous related record.

The court heard that MacLean, at the time the crime was committed, was battling a drug addiction and dealing with the death of his father.

Since then, as noted in his presentence report, he has taken numerous steps, including treatment, to deal with his addiction and is not using.

His lawyer, Jonathan Matters, said MacLean now has a stable home, stable relationship and continues to make good progress and also been accepted into the culinary program at Holland College, which starts in September.

“When I committed this offence I really wasn’t in the right frame of mind,” said MacLean, who opted to address the court before being handed his sentence.

“I understand I deserve anything and everything I get today.”

Judge Jeff Lantz did give MacLean credit for steering his life in the right direction since the crimes were committed, adding he has “made some strides.”

“Unfortunately, I think a period of custody is required to some degree,” said Lantz, who sentenced MacLean to 90 days in jail followed by 24 months probation.

As part of his probation, he must undergo assessment, counselling and treatment for any mental health or addictions issues, pay restitution of $501 for damage caused to one of the cottages, and stay away from the vandalized cottages.
