Man gets jail time for sexual assault

A man who raped a woman he met through an online dating website will be going to prison for 27 months after a judge sentenced him in P.E.I. Supreme Court today.

Jeffrey Lee Hogg, 32, appeared before Justice Ben Taylor for sentencing after he was found guilty in October of sexual assault.

In handing down the sentence, Taylor said he agreed with rulings from other judges that there should be a starting point for sentences in sexual assault cases.

Taylor said the starting point in Hogg’s case should be about two years in prison based on similar sentences in other cases.

Hogg met the victim through online dating service Plenty of Fish where he went by the profile name “easygoingguy11” and told her his name was Chris MacDonald.

He also went by the name Chris Diamond.

Hogg and the victim were supposed to go for a walk on the beach on their second date, but instead he drove to a field where they kissed and got into the back seat of his truck.

It was there that he raped her.

Although Taylor used two years as the starting point for the sentence, he said there were aggravating factors in the case.

Although Hogg didn’t use a weapon and the victim didn’t suffer any physical injuries, the sexual assault was forceful and violent, Taylor said.

Hogg, who is overweight and much larger than the victim, held her down and forced her legs apart.

Taylor said the victim was unable to move or offer resistance because of Hogg’s weight and strength.

A degree of planning was also an aggravating factor with Hogg taking the victim to the field and intending to coax her into the back of his truck, Taylor said.

He said that if Hogg had been successful he would have had sex with the victim whether she wanted to or not.

When it came to mitigating factors, Taylor said there were many things about the case that had no effect on sentencing, such as Hogg taking the case to trial, which didn’t spare the victim from having to testify.

Taylor said Hogg’s girlfriend described him in positive terms, but there were no other mitigating factors.

Throughout the proceedings Hogg sat at the defence table with his head down and he showed little emotion when Taylor sentenced him to 27 months in prison.

Hogg will have to provide a DNA sample for the national databank and his name will be on the sex offender registry for 20 years.

    If you have never been raped then you will never understand the emotional trauma a victim goes through. Just because you do not see black eyes and bruises all over a body does not me you have been less violated. I will have to live with this the rest of my life, the shame, the embarrassment. My reason for coming forward was to help other women see that you are not alone. There have only been two sexual convictions on PEI in over five years. Put this in comparision to the waiting list to see a rape counselor on PEI..over a year waiting list in Summerside alone. Many women are afraid to come forward just like I was not only because of the hurt and embarrassement but they believe that the court systems will not believe them. Judge Ben Taylor believed me and Jeffery Lea Hogg received an appropriate sentence for the violence and the hurt that he inflicted upon me. My life will never be the same. PEI will never be my home again nor will I ever feel safe there again. My life was going in a positive direction until I met up with this man and he took that all away from me. After many months of counselling I have asked God to help me find a way to forgive this man for his violation of me and now as a Christian I can say I forgive him but I will NEVER forget what he did too me or what he took from me. Thank You Judge Taylor for your decision and for seeing through the lies that this man spew forth to the courts. My only wish is that other victims will come forward now and stand up to these perpetrators for this is the only way you will ever set yourself free. I am now moving on with my life and if I can help other women along the way or my story touches one woman to come forward then it has all been worth it. Many times I wanted to give up. I was tired of the humiliation and the system but one thing kept me going and that was my determination that no other woman would have to go through what I went through. You may not see the scars on the outside but the mental scars last a lifetime. I feel very sorry for Jeffery Lea Hogg and I can only hope that he turns his life around in prison, as I know he has a young son and is this what you really want to teach him. I ask that my name not be published..not to protect me but my family. This has been the most difficult time of my life but I came out on the other side strong and I will NEVER be anyones VICTIM again for I am a SURVIVOR!

    Wait just one cotten picken minute , this guy gets 27 months for this crirme ( that i agree he deserves if not longer in my eyes ) but a 80 year old man gets no jail time and i think 18 months probation for pleading guilty for sexual assult against two under age girls ? This makes no sence to me at all, PEI needs to get rid of its court system and let a Provincal court system in NS or NB handle its cases , this is not the 1st time this kind of thing occured , it makes me sick to my stomach , just because the man is 80 years old , i didnt think that there was any age factor for sexaul assult expically with minors , 12 or 80 your found guilty you need to go to jail , god you need to open the eyes of someone who has some pull to really take a look at our court systems , Its CRIMINAL IN ITSELF

    Very smart Judge! It took a few strong willed women to stand up to this man to make him finally accountable for his actions. He had over seven different profiles on POF where he lured women in with his lies!

    People, read the whole article. It sounds like there was no intercourse, but an assault. "He said that if Hogg had been successful he would have had sex with the victim whether she wanted to or not." Had, being the key word...

      Hi Natalie, The judge is just backing up his sentence by pointing out there was a plan -- Hogg planned to have intercourse whether she wanted to or not, if he was successful driving her to the field and getting her into the back seat.     I don't despute a 2 year sentence for rape people think they can just do whatever they want to people? Rape is a horrific violent crime and the people who experience it have lifetime effects from the event. In India he would likely be castrated.
