Man gets jail time for stabbing attempt, uttering threats

A 46-year-old man who tried to stab his son with a fork and threatened to cut the child's mother's throat will be spending time in jail after he was sentenced in provincial court Monday in Charlottetown.

The man, who The Guardian has chosen not to name to protect the victims' identities, appeared before Judge Nancy Orr where he pleaded guilty to several charges, including assault with a weapon and uttering threats.

During Monday's proceedings, Crown attorney Jeff MacDonald told the court the man and the boy's mother had two children together and had been in a relationship off and on for 18 years.

On Aug. 31, the man threatened to cut the woman's throat after the couple had an argument over him smoking a cigarette.

MacDonald said there were several incidents of violence and threats in the relationship over the years but it was the first time she feared for her safety.

On Oct. 5, a different woman reported two death threats the man made toward the boys' mother through text messages.

In one of those texts the man said he was going to try to lure the boys' mother away from her work by pretending to be nice.

The threat said he would then take her to a secluded area and choke her to death.

"I think I will kill her real soon," he said in one message.

MacDonald also told the court about an Aug. 13 incident during which the man tried to stab his 12-year-old son with a fork because the boy interrupted a conversation between the parents.

The boy pulled his arm away in time and the fork stuck in the table.

He then left the house and moved in with his grandparents.

In another incident, for which the man wasn't charged but the details were read into the record, he threw the couple's other son into his bedroom where he hit the bed and broke his arm.

Along with the charges for uttering threats and assault, the man also breached an order not to contact the woman when he sent her non-threatening text messages.

He also failed to appear in court on two occasions in November and was arrested after warrants were issued.

In recommending a sentence, MacDonald said the charges were serious with the man abusing his sons and making multiple threats to people by multiple means.

Deterrence and denunciation were important in this case, MacDonald said, and he recommended 60 days in jail along with a period of probation.

Defence attorney Randy MacDonald told the court the man, who has seven children with different women, acted hastily out of frustration when he tried to stab his son.

He also said the man was horsing around with the other boy when the child hit the bed and broke his arm.

The man spent 28 days in custody prior to his sentencing and had attended counseling during that time, Randy MacDonald said.

Before handing down a sentence, Orr said if the man wants a relationship with his sons he needs to make significant changes.

She also said the nature of the threats is at the upper end of the scale.

"It's a matter of great concern," she said.

Orr sentenced the man to 60 days in jail, minus credit for the time he was in custody, which left him with 32 days to serve.

The man will also be on probation for two years and Orr included the woman and their sons in a no-contact order as one of the conditions in the probation.

Orr ordered the man to write an apology letter to the victims and he will have to provide a DNA sample for the national databank.

      Are you for real you think she should go easy on drunk drivers on PEI, i hear they make the news a lot buddy maybe that's why she's so hard on them.

    I get a kick out of the comments as if Judges make up the laws on their own, they apply the laws that are written by government judes can't make up sentences on a whim.

    WHAT A JOKE ! A Crime with no JUSTICE, So what happens next month,my bet is he will kill someone. Orr thee tax payers gave you that job and can take it away from you.

    Judge Orr was so concerned that she sentenced him to a whopping 32 additional days.... wonder what would she give as a sentence to the "lower end" of the scale ... a dinner for two?

    This man obviously needs to have his anger management issues worked on as well as a seeing a doctor about mental issues. Who threatens to kill someone over being confronted about smoking a cigarette or tries to stab their son for interupting a conversation? This man needs serious help and if he doesn't want it or doesn't change then he needs to be locked up indefinitley to protect everyone else!

    tried to stab his 12 year old son with a fork, and had previously thrown his other son into his bedroom where he hit the bed and broke his arm..this Man (and I use this term loosely) should be incarcerated for a long long time.. or are you going to wait, until he seriously physically harms or kills someone.. the damage he has done already, is incomprehendable... Wake Up.. I'm so sick of hearing of the Rights of the Accused... what Rights do they give their Victims?

    I commend the Guardian for withholding the names of the people involved. The difficulty this poses for the family and the victims of the offender are far worse than people think. It can be shameful and embarrassing, especially for children, to deal with the gossip and scrutiny that situations like this create. This is a matter for the police and Child Protection Services to deal with~ the need for the public to know the identities of these people is minimal. I would like to see this trend continue. To be clear, my concern is primarily for the family and the victims, not for the offender. That being said, there is little evidence that being publicly humiliated will create a positive change in behaviour.

    Juge Nancy ORR, you really disappoint me on this one, this guy has some serious issues, now we have multiple victims with life time scars and this guys gets to do another 32 days, what kind of message is this sending out to these abusers, this is exactly what he is, just imagine how many times these women and all his children were subjected to continued physical and mental abuse, this guy should of got a ten(10) years in Dorchester for this number of serious charges, than we would see how tough he is. Disgraceful sentence. Whats with the Crown recommending such a sentence. This Jeff MacDonald lawyer should be taken to task for such a display, I would hope this will be passed by the Chief of Crown Attorneys and maybe the Attorney General, what the hell happened here.

      sadly, this is the kind of *cough* lawyer is EXACTLY the kind of person that gets promoted to Chief (or even better, a JUDGE)...why? b/c of the complacency and adleminded attitudes...they forget about the victims however open their arms to the thugs! My condolences to the victim's in this case...maybe he will have an 'accidental' slip in the shower...HAHAHA!!!!

    Speaking as a "Survivor" of Domestic abuse ... here is the answer many ask ..."Why don't you charge the abuser?" What a "victim" is put through on the witness stand is pure horror,I know,I've been there and to think all that comes out of it is what boils down to days in the Hollow Hotel. Oh, but this dude got it bad from the judge ...(sarcasm) he has to write a letter of apology,oh my... that will insure it won't re occur! Nothing changes if nothing changes.

    no-contact order. LOL NO TEETH and with no name when he gets out who is going to protect the rest of the people of PEI from him? this protect the name of the guilty oh you MUST PROTECT THE GUILTY.

    Randy MacDonald...hand in your law diploma if you believe this A hole was ?? horsing around or frustrated when he assaulted the children. The adult female in this case needs some BIG TIME mental help. ANY mother who could allow an idiot to physically assault her children should not be considered a mother and the children should be moved to a safer place immediately. Do you really think a further 32 days in the hollow will make this moron understand it's not OK to kill your mate because she/he doesn't agree with you??? Thanks to the grandparents for removing the child from danger. For sure we will read of this couple again...possibly in the obits!!!
