Sexual interference with teenager results in nine-month jail term

A 58-year-old Tignish man was sentenced Wednesday in P.E.I. Supreme Court to serve nine months in the provincial correctional centre for engaging in an act of sexual interference with a young teenage boy.
The sentence was imposed in the case of Cyril Joseph LeClair.
LeClair received a second nine-month jail sentence for inviting the same teenage boy to touch him in a sexual manner.
The two sentences will be served concurrently.
Upon completion of his jail sentence, LeClair will spend the next two years on probation, during which time he is to undergo assessment, counselling and treatment for any underlying issue that may have contributed to the commission of these offences.
Supreme Court Justice John Mitchell also ordered LeClair to provide a sample of a bodily substance for the national DNA databank. His DNA will be kept on file for 10 years.
LeClair must also register with the national sex offender information registry.
His name will remain on the registry for 20 years.
Mitchell put in place an order prohibiting LeClair from attending at any park, swimming area, school ground or community centre frequented by persons under the age of 16 unless accompanied by an adult who does not have a criminal record.
He is prohibited from working with children and is not permitted to use a computer system to initiate contact with children.
Both offences with which the accused was charged occurred on the same night.
LeClair pleaded not guilty to those offences but was found guilty at the conclusion of a four-day trial during which the victim testified at length about the incident.
The court was told the incidents have had a significant impact on the victim's emotional health and well-being.
The victim, whose identity is protected by a publication ban, can't understand why these things were done to him.
Mitchell told the family of the victim to tell him he did nothing wrong here.
The Crown described the incidents as high-end sexual offences and asked for jail sentences of between eight to 10 months.
LeClair's defence counsel had proposed a jail sentence of possibly five or six months.
LeClair had no related criminal record and was well regarded in his community.

    To Melissa from PEI. I think Gerry means that the dark ages of sexual crimes were when they were covered up by everyone with no real punishment to the offender, I totally agree with him what benefit will the victim get knowing his attacker is going to serious, comprehensive, and well-grounded treatment? If i were the victim id feel better in the fact that hes locked up for life, not 9 months in holidayhollow, then get out and ruin another life. Bring back the death penalty for sex crimes that will stop re offenders.

    Life Sentence for the Victim.....What a shame we couldnt give the offenders the same. Sexual Assault Victims need a HERO.....I hope I live to see the day that we get one!!!!

    Gerry, the rehabilitative sentencing Canada uses IS the move out of the Dark Ages. However, pedophiles are notoriously resistant to rehabilitation. I hope the counselling and treatment is serious, comprehensive, and well-grounded in the latest research, and not just going through the motions to satisfy a Court order, for the sake of the entire community.

    It's high time the PEI Justice system moved out of the dark ages and set a precedent not only on the Island, but in the country, by imposing real sentences on sex offenders.

    Take the lead PEI. Stand up and be recognized as a province which no longer just slaps people on the wrists with a feeble warning. It's like saying, How many times do I have to tell you?

    Why is sexual abuse not taken seriously by the justice system? A young person's life has been traumatized and scarred.

    Who cares if LeClair DIDN'T have a criminal record and WAS well regarded? The fact remains, it has been proven he IS a sexual deviant. How many victims are there whom we don't know about?

    I'm sure the boy's dad and maybe a couple of uncles could deliver a more just penalty in 10 minutes out behind the courthouse.

    When is someone going to do something about our Justice System!!!

    This was a young boy sexually molested/assaulted by a Grown Man!!

    (LeClair had no related criminal record and was well regarded in his community.) What does this have to do with his sentence? And how exactly is a man who engages in this type of behaviour well regarded by his community?? His community? or a few of his friends?

    And what does no related criminal record mean? He had previous charges of another nature?

    And what is this supposed to represent?
    (sexual interference with a young teenage boy.) Interference? It sounds like something one would expect to hear at a Hockey Game!

    Our Justice System is badly broken and Someone Needs to do something NOW!
    Our children and citizens need to be protected!

    Wow. The justice system here is a joke. Disgusting. Sexual pervs should all do jail time, if anything it will keep them away from innocent kids for at least the time they're inside.

    What do you have to do in PEI to get sentenced to real jail time? Attempted murder by stabbing - 3months. High-end Sexual assault - 9 months. The ability to get away with crime on PEI - PRICELESS!

    Another victory for the Guilty, nine months what a joke and a slap in the face to all parents. This predator raped a young child and traumatized him for life and the court say,s nine months jail time is sufficient retribution. The Justice system shames me and it should shame all people into voicing there opinion on sex related crimes perpretrated against children. Do we have to lock our children up because there is no protection for them. Everyday we entrust the care and lives over to the care of strangers such as teachers,priests,police,relatives,babysitters Yes there all kinds of predators in sheeps clothing. As parents all we can do is make sure our children feel comfortable enough to speak of anything with us and they will not be judged or condemned. We have to become more involved in the lives of our children so we are more infomed as what is happening in their lives.
